Class action lawsuit filed over Jackson County assessments

KANSAS CITY, Mo. (KCTV) - A new class action lawsuit challenges the quality of Jackson County’s property assessment. It calls into question if some increases are even legal considering some notices came in the mail after the June 15 deadline, as required by state statutes.

The filing asks a judge to step in and offer injunctive relief. It also calls for a jury trial.

The lawsuit was filed by attorney and developer Ken McClain on behalf of Trevor and Amanda Tilton of Odessa and two businesses.

The lawsuit is critical of the methodology used by Jackson County to reach new values. It argues the newly-built assessment system fails to include sufficient information and there’s a lack of physical inspections.

It points out assessments should consider current market conditions. It argues that didn’t happen when it came to commercial property.

The lawsuit claims Jackson County uniformly increased the value of every non-vacant commercial property with an improvement by 25%. And vacant commercial properties had an across-the-board increase of roughly 50%.

KCTV5 has heard from numerous homeowners who are shocked by the large increases in their assessments. Some question if they’ll be able to keep their homes. They also question if they can realistically sell when property tax assessments increase so much in one fell swoop.

There has been a 30% average increase in Jackson County. The Assessor’s Office argues homeowners are seeing large increases because Jackson County real estate has not been assessed with Fair Market Valuations (FMV) for a long time and building costs have increased.

The lawsuit is filed against Jackson County Executive Frank White, Assessor Gail McCann Beatty and other members of the Board of Equalization.

KCTV5 reached out to Jackson County’s public information officer for comment but we have not heard back yet.

Yeah, it kind sucks to have your taxes based on the current market (keep going up).

Austin area is a good example of how this kind of tax system can force people to sell.



As you know CA doesn't do that when you are a home owner.

Nah it will still sell for twice what I paid for it, at least. Not worried about that.

County has to be fought tooth and nail for trying to steal from people though. You don't fight them now it will be worse next time.

We should forward this post to all of our elected reps. Best idea I've heard. I have paid a LOT of taxes for over 60 years. I'd appreciate a break.

I have a neighbor across the street, two doors up, who's house has a couple of more features than mine - plus a new roof (I need one).....etc....valued by the county as $190k less than mine.

Another neighbor put his house up for sale for more than his realtor says he could get. His asking price is $65k below what the county has as his value. And he probably won't get that.

But the county does have lots of expenses, so they need the extra dough, what with removing statues and stuff. That ain't free ya know!

A bill signed by Gov. Mike Parson that aims to bring property tax relief to Missouri senior citizens could end up in court. The legislation, sponsored by Sen. Tony Luetkemeyer, R-Parkville, would allow counties to freeze the property tax rates of Missouri seniors.

Doug Hayter, executive director of the Missouri Association of School Administrators, said the bill is vague.

“What is Social Security eligibility? Is it just at 62 to 65, 67, et cetera? How do you gather that information on birthdates about the person of the primary residence turns 65, so there’s a lot of semantics I think involved in the implementation of this that can be really tricky,” said Hayter. “Some have even questioned does the language say, is it insinuating this is only for the county’s portion of property tax paid? We don’t believe that’s the case. We think it means all taxing jurisdictions, but that question has been raised as well. So, I will be surprised as well personally, if this doesn’t eventually end up in court.”
