Class action lawsuit filed over Jackson County assessments

KANSAS CITY, Mo. (KCTV) - A new class action lawsuit challenges the quality of Jackson County’s property assessment. It calls into question if some increases are even legal considering some notices came in the mail after the June 15 deadline, as required by state statutes.

The filing asks a judge to step in and offer injunctive relief. It also calls for a jury trial.

The lawsuit was filed by attorney and developer Ken McClain on behalf of Trevor and Amanda Tilton of Odessa and two businesses.

The lawsuit is critical of the methodology used by Jackson County to reach new values. It argues the newly-built assessment system fails to include sufficient information and there’s a lack of physical inspections.

It points out assessments should consider current market conditions. It argues that didn’t happen when it came to commercial property.

The lawsuit claims Jackson County uniformly increased the value of every non-vacant commercial property with an improvement by 25%. And vacant commercial properties had an across-the-board increase of roughly 50%.

KCTV5 has heard from numerous homeowners who are shocked by the large increases in their assessments. Some question if they’ll be able to keep their homes. They also question if they can realistically sell when property tax assessments increase so much in one fell swoop.

There has been a 30% average increase in Jackson County. The Assessor’s Office argues homeowners are seeing large increases because Jackson County real estate has not been assessed with Fair Market Valuations (FMV) for a long time and building costs have increased.

The lawsuit is filed against Jackson County Executive Frank White, Assessor Gail McCann Beatty and other members of the Board of Equalization.

KCTV5 reached out to Jackson County’s public information officer for comment but we have not heard back yet.

Yep, the builder can list the house for whatever price they want. Doesn't mean someone is going to pay that. I can't imagine paying over 500k to live in that shitty neighborhood next to a bunch of people that don't care to take care of their property. I'd rather shoot myself than to pay that much to live in a neighborhood that people like Clay can afford to live in.

Hey it won't be handed to anyone but there is opportunity if one persists.
I bought my first home in north KC for 145k, I only updated one bathroom and sold it for 230k in 21. Bought a house in Johnson county for 300k house prices have been insane and I feel lucky that I bought and sold when I did.

I worked for NIC before it was bought out by Tyler Technologies, I left the company after the buyout. There's only two possibilities; either Tyler's code is incorrect to which Jackson County should be able to directly point to in a court case, should there be one, or Jackson County told them in specifics what they wanted and Tyler delivered, which Tyler should be able to easily prove in a court case, again should there be one. Tyler Technologies bought out many companies over the past few years, so I can't say for sure if the one I worked for in Olathe was the one responsible for the code, but there are good people there, led by a good team of leaders that I was sad to leave.

If the code was the problem, or something that Tyler Technologies did, then Jackson County would be rolling back to something that is accurate and not forcing people to go through an appeals process on this, somehow I don't think we should be laying all the blame at Tyler Technologies so I look forward to finding out more about where the issue actually occurred in due time.

Stevie, here is a home for 695k in Denver which is a price of $149 sq. ft. It sold in 2016 for 414k. In one of the biggest real estate pricing booms we have seen in our lifetimes, the price of this property went up 280k over 7 years. That isn't normal and will not continue with today's interest rates and the slowing of the real estate market.

Stop with the clutching of pearls about home prices. The market will adjust like it always does.
