All of the people in the Lamborghini and the Corvette know who was driving. Maybe they are all tough guys who won't spill the beans, but the same thing that seemingly would protect the driver (having other people in the vehicles) also seems like a potential liability.

If video of him exiting the passenger side second immediately after the wreck isn't good enough, then literally nothing can ever be proven by circumstantial evidence and object permanence is a myth.

What if a camera trap caught him driving a mile before the wreck? They could have switched seats in that last mile!

You'll find that there are FAR more Casey Anthony jurors in the world than there are jurors that are eager to draw inferences in a criminal proceeding.

I mean people will STILL say "You can't convict on circumstantial evidence" which remains one of the single dumbest statements I've ever heard. But people will die on that hill. Defense attorneys will still argue "The entire case is circumstantial" as though that means a hell of a lot. DNA evidence is technically circumstantial ("His DNA is on the murder weapon therefore we will infer that he used said murder weapon to kill the victim).

Direct evidence is rare. And oftentimes not good. Eyewitness testimony is direct evidence -- "I saw Rice driving" but eyewitness testimony is empirically and demonstrably unreliable as hell.

Yes, you can absolutely draw the inferences to convict and doing essentially exactly what you've laid out. -- "Hey, the video shows he was the second guy out of the passenger side - you think they swapped seats at impact?" -- but prosecutors are loathe to spin that wheel because jurors are stupid and obstinate.

All depends on traffic cameras. If they went through any toll gates, the driver of each vehicle would be caught on camera. Dallas has a ton of toll roads and it's hard to avoid them for the most part.

Oh sure.

And then Rice points the finger back at him and his lawyers say "Hey, this guy's lying to save his own skin..." and then go digging for any number of things that could blast his credibility to hell and blah blah blah.

Now, bricks make walls so with enough of them you will eventually get that circumstantial case put together and it might stick. But it's gonna take a lot of time and money to try to get a juror to slap the guy with the high side of a misdemeanor conviction? Eh. The Dallas DA has bigger shit to worry about.

I was under the impression that a lot of people in the US get convicted on joint enterprise laws when the prosecution can't prove which person out of a group of people committed the offense. Granted, I've generally only heard of joint enterprise convictions for more serious offenses like murder so I don't know if they're more widely used for lesser offenses like wreckless driving.

I'm assuming they can prove he was driving, still traffic violations and a misdemeanor. The NFL will give him 2-4 for leaving the scene, probably 2.

This will be a minor bump in the road. The press is now quiet on the issue. No articles on ESPN beyond the first short blurb. none of the pundits talking about it. Doesn't matter if he was driving the Case will be a misdemeanor at best. There is no violence involved. I don't think there will be a suspension. No violence, no evidence of drugs or alcohol. Accidents happen every day. Wouldn't even make the news if it were an ordinary person.
