Class action lawsuit filed over Jackson County assessments

KANSAS CITY, Mo. (KCTV) - A new class action lawsuit challenges the quality of Jackson County’s property assessment. It calls into question if some increases are even legal considering some notices came in the mail after the June 15 deadline, as required by state statutes.

The filing asks a judge to step in and offer injunctive relief. It also calls for a jury trial.

The lawsuit was filed by attorney and developer Ken McClain on behalf of Trevor and Amanda Tilton of Odessa and two businesses.

The lawsuit is critical of the methodology used by Jackson County to reach new values. It argues the newly-built assessment system fails to include sufficient information and there’s a lack of physical inspections.

It points out assessments should consider current market conditions. It argues that didn’t happen when it came to commercial property.

The lawsuit claims Jackson County uniformly increased the value of every non-vacant commercial property with an improvement by 25%. And vacant commercial properties had an across-the-board increase of roughly 50%.

KCTV5 has heard from numerous homeowners who are shocked by the large increases in their assessments. Some question if they’ll be able to keep their homes. They also question if they can realistically sell when property tax assessments increase so much in one fell swoop.

There has been a 30% average increase in Jackson County. The Assessor’s Office argues homeowners are seeing large increases because Jackson County real estate has not been assessed with Fair Market Valuations (FMV) for a long time and building costs have increased.

The lawsuit is filed against Jackson County Executive Frank White, Assessor Gail McCann Beatty and other members of the Board of Equalization.

KCTV5 reached out to Jackson County’s public information officer for comment but we have not heard back yet.

The whole thing is just a giant ****ing shit show. On top of the runaround to even get an appeal, you've got various legislators wanting to set parameters and a lawsuit on the horizon. What the **** are these people even supposed to do?

Also pretty obvious whatever algorithm Tyler used to assign these values is ****ed beyond belief. And even if the property tax rate is legit it's pretty ****ing nuts to just drop an increase like that on someone and not have it gradually increase.

Syrios said he has filed appeals on many of his properties, but if the assessed values don’t come down, he plans to sell some of his buildings and raise the rent for tenants in his remaining buildings. Oren Gamble, a local landlord who owns three single family rental homes in Jackson County, said one of his home’s values went up by $60,000 this year.

He said he has never received an assessment so high or felt forced to raise the rent on his tenants, adding that he prides himself on offering an affordable rent for quality housing. “I actually provide what I feel is home above what most people do provide as a landlord,” he said. “I want the house to be something that I would also be comfortable living in.”

If his tax bill ends up being too high to break even, Syrios said he’s considering selling some of his properties. Any money he makes off of any sales will likely only cover this year’s property taxes, he said.

But this option could have unintended consequences for tenants and neighborhoods, he said, opening up the possibility for out-of-state investors to buy up more housing across the county.

Citywide tenant union KC Tenants raised similar concerns in 2019 when tax values spiked.

“If the assessments push more local owners out of the market, their properties will almost undoubtedly be purchased by out-of-state real estate speculators with no real stake in our community,” KC Tenants said in a statement at the time. “Those corporate owners can be some of the worst, most exploitative landlords and are often unaccountable to tenants, neighbors and the city.”

Data obtained and published by The Star in a 2021 investigation revealed that Kansas City’s East Side has become a hot zone for investors and speculators from across the Kansas City region, all 50 states and at least a dozen countries as far off as Australia and Ukraine.
