There is a lot of fake news going around (even here) that the new abortion laws in New York only allow for abortions after 24 weeks for "exceptional cases" or "extreme circumstances". This is FALSE. I've read through the entire bill and all of the penal/health/education laws that it repeals so you don't have to. Here is the REAL DEAL on what this abortion bill actually does.

Prior to this bill, it was illegal for anyone who was not a licensed physician to perform an abortion. This bill makes it legal for a practitioner of medicine or someone "Certified" (whatever that means) to perform abortions up to 24 weeks for any reason. After 24 weeks they may only perform an abortion is the pregnancy isn't viable or the life of the mother is in danger. It is important to note that the main thing about this section of the bill is that now people that are not licensed doctors may perform abortions. The 24 week language here is not important, and we'll get to why in a second:

A health care practitioner licensed, certified, or authorized under title eight of the education law, acting within his or her lawful scope of practice, may perform an abortion when, according to the practitioner's reasonable and good faith professional judgment based on the facts of the patient's case: the patient is within twenty-four weeks from the commencement of pregnancy, or there is an absence of fetal viability, or the abortion is necessary to protect the patient's life or health.

So why is it being said that abortions after 24 weeks are made legal by this bill? Well because this bill does exactly that. To find out how, we have to dig deeper. I'm not going to go into every penal law that the bill repeals/changes, just the important ones that you need to know about. Sections 125.40, 125.45, 125.50, 125.55 and 125.60 of the penal law are REPEALED

What do these sections say that are being repealed here? Let's take a look:

Section 125.40 of the penal law (https://www.nysenate.gov/legislation/laws/PEN/125.40)

A person is guilty of abortion in the second degree when he commits an abortional act upon a female, unless such abortional act is justifiable pursuant to subdivision three of section 125.05. Abortion in the second degree is a class E felony.

Now we have to read 125.05 to find out what the exceptions are (https://www.nysenate.gov/legislation/laws/PEN/125.05)

"Justifiable abortional act." An abortional act is justifiable when committed upon a female with her consent by a duly licensed physician acting (a) under a reasonable belief that such is necessary to preserve her life, or, (b) within twenty-four weeks from the commencement of her pregnancy. A pregnant female's commission of an abortional act upon herself is justifiable when she acts upon the advice of a duly licensed physician (1) that such act is necessary to preserve her life, or, (2) within twenty-four weeks from the commencement of her pregnancy. The submission by a female to an abortional act is justifiable when she believes that it is being committed by a duly licensed physician, acting under a reasonable belief that such act is necessary to preserve her life, or, within twenty-four weeks from the commencement of her pregnancy.

Ok so now we see that they are removing the requirements for a legal abortion to be within 24 weeks, for the abortion to have to be done by a licensed physician, or that the mothers life needs to be in danger. These requirements no longer exist, this paves the way for them to allow people who are not doctors to perform abortions and for abortions after 24 weeks to be legal.

Also being repealed is Section 125.45 (https://www.nysenate.gov/legislation/laws/PEN/125.45)

A person is guilty of abortion in the first degree when he commits upon a female pregnant for more than twenty-four weeks an abortional act which causes the miscarriage of such female, unless such abortional act is justifiable pursuant to subdivision three of section 125.05. Abortion in the first degree is a class D felony.

VERY important to note that this is about murders who cause the death of an unborn child by harming the mother, say a drunk driver hitting a pregnant woman where the mother lives but the baby dies. This removes the penalty for killing the child.

Section 125.50 has been repealed as well (https://www.nysenate.gov/legislation/laws/PEN/125.50):

A female is guilty of self-abortion in the second degree when, being pregnant, she commits or submits to an abortional act upon herself, unless such abortional act is justifiable pursuant to subdivision three of section 125.05. Self-abortion in the second degree is a class B misdemeanor.

Section 125.50 is the same as 125.40, except it's when a women does the illegal abortion to herself. This makes it legal for a woman to kill her child after 24 weeks on her own.

A person is guilty of issuing abortional articles when he manufactures, sells or delivers any instrument, article, medicine, drug or substance with intent that the same be used in unlawfully procuring the miscarriage of a female. Issuing abortional articles is a class B misdemeanor.

What else do we have in this bill? It says:

Section 4164 of the public health law is REPEALED.

When an abortion is to be performed after the twelfth week of pregnancy it shall be performed only in a hospital and only on an in-patient basis. When an abortion is to be performed after the twentieth week of pregnancy, a physician other than the physician performing the abortion shall be in attendance to take control of and to provide immediate medical care for any live birth that is the result of the abortion. The commissioner of health is authorized to promulgate rules and regulations to insure the health and safety of the mother and the viable child, in such instances.

2. Such child shall be accorded immediate legal protection under the laws of the state of New York, including but not limited to applicable provisions of the social services law, article five of the civil rights law and the penal law.

3. The medical records of all life-sustaining efforts put forth for such a live aborted birth, their failure or success, shall be kept by attending physician. All other vital statistics requirements in the public health law shall be complied with in regard to such aborted child.

4. In the event of the subsequent death of the aborted child, the disposal of the dead body shall be in accordance with the requirements of this chapter.

But we aren't done yet, we still have subsection 8 of New York Education Law 6811 that was repealed:

Subdivision 8 of section 6811 of the education law is REPEALED.

Any person to sell or distribute any instrument or article, or any recipe, drug or medicine for the prevention of conception to a minor under the age of sixteen years; the sale or distribution of such to a person other than a minor under the age of sixteen years is authorized only by a licensed pharmacist but the advertisement or display of said articles, within or without the premises of such pharmacy is hereby prohibited;

So there you have it. Exactly how New York bill S00240 made it legal to perform abortions after 24 weeks, and removed criminal penalties for people that kill unborn children in the process of hurting their mothers. This is one of the most disgusting things I've ever seen coming from the left.
