The problem is there is no way to determine whose fence it is. It's old as **** and it's a shadow box design so the posts aren't on a specific side.

If it's built on your property, it's yours and good side points out is the rule in most nice areas I have lived it.
Go out to it with a chain saw and cut it out. Tell him that as soon as the homeowners assn ok's the replacement design, you will install a new one, meantime chain up your dogs... Oh and you are paying 1/2 the cost. Why did you destroy it? It was beyond the point of securely retaining your dogs.... |

You need to get a sense of humor, Are you really thinking I am suggesting that he take a chain saw to it. but if his property has a survey, and pins can be located that prove the fence is on 007's property, he could destroy it with what recourse from his neighbor? "you tore down your fence?" If ownership is in question, deliver the debris to his driveway... He removed a section of fence built on his property... I advised him to call his title insurance carrier... Bad advise? He has not done so.... |

I have been there, done that. The pins were where they were suppose to be. Judge looked at defendant and asked if he wanted to contest or pay 1/2 of a full blown survey vs the proof sources given. Same info on each parties mortgage paperwork.

As I said, the judge gave the defendant the opportunity to pay you but since the same survey documents on their property had the same pis locations the other party waived their option.
The judge basically said loser pays the bill. What would the bill be for a residential survey and testimony???? I posted before where I made a claim against Home Savings in a manner and they paid a survey as part of discovery. they purchases said properties from 2 homeowners to make me whole w/o a judge. |

I had a neighbor who treated me like that, I dig a 20' deep trench, put in a 18" plastic growth guard and planted 50 bamboo sprouts along the property line, they were about 6-7 high and sprouts were about to reach the property line when I sold. That is the view from MY DECK. The firepit is mine. The garden is the neighbor to the right.
The trees are less than a foot away from the perceived property line. I was told by the city that I could put them on the line--but would be best to put them inside as not to cause confusion. The shed is not mine but of legal size. But I still think it is too close to the property line. Everything behind the tree is the neighbor that is the pain. |

As a kid growing up, we had a somewhat similar situation but not too hostile.
Our neighbor had a HUGE 120-150 year old oak that was huge and one gigantic branch as thick as a giant pumpkin grew across their fence and across 30% of our backyard, including over a small portion of our roof. What was annoying was that not only did the tree shed branches and leaves like crazy but it rained acorns on our roof for many months during season. We also had NO TRESS in our backyard yet had bags upon bags of leaves before winter to rake as kids. Drove me crazy. |
You are allowed, actually required, to maintain the tree that grows over your property. If it falls and damages your house, it's your problem.

I would order a survey and encroachments have the surveyor pay particular attention to adjoining fences. If it over the line demand to have it moved with a lawyers letter like they did. Then put a taller privacy fence along that assholes line.

On construction sites OSHA requires rebar caps be placed over exposed rebar so not to be impaled. If I was that neighbor Id fire back with a lawyers draft of inherent dangers of kids being impaled on the fence.
