You are allowed, actually required, to maintain the tree that grows over your property. If it falls and damages your house, it's your problem.

Last time I lived in a community I couldn’t tell you how many time the President of the HOA walked through crosshairs.

I would order a survey and encroachments have the surveyor pay particular attention to adjoining fences. If it over the line demand to have it moved with a lawyers letter like they did. Then put a taller privacy fence along that assholes line.

I would bet that PVC fencing not anodised aluminum or steel it can be fragile especially if the kids climb it to retrieve ball.

You can cut the limbs on your side also. Only caveat is if the tree is dying write a lot to the neighbor he needs to take care of it and certify it. If the tree does come down from neglect and damages your house then he has to pay.
